Bandra Navpada Kokni Community

KOKNI MUSLIM JAMAT,
Navpada Bandra Bombay.

The Kokni Muslim Jamat, Navpada Bandra was established by our ancestors around 300 years ago.
           
            The Founder members were the Kokni residents of Navpada Bandra, Bombay.

The Jamat controlled and maintained a Masjid and cemetery at Navpada Bandra and a Muslaman saint’s Dargah at Golibar, Santacruz. They were the Mutavalees of the Masjid, cemetery and Dargah.

Statements of the trustees in support of the Jamat’s existence

1.                  In the year 1908 Managing trustee of the Navpada Masjid Mr. Haji Suleman Usman Mahimi stated to the Mamledar, south Salsette that the whole land of 18 Gunthas of the Dargah at Santacruz is in their possession for over 200 years.

2.                  On 12th. April 1927 the same managing trustee repeated to the Development officer for Salsette that we are making Vahiwat as kabrastan of the land S. No. 304 for more than 200 years.

The Navpada wakf is constituted by the Kokni Muslim Jamat of Navpada from time immemorial.

GOLIBAR DARGAH

      Dargah and the land around it, is comprising of 2134 sq. yds. is confirmed in the occupancy of the said land by the Govt. of Bombay on 30th. June 1948 by issuing of the Sanads for the land.

      Before Bombay Public Trust Act 1950, it was registered with the Thane Dist. Court under Registration No. T-156, along with Navpada Masjid Bandra and Navpada Kokni Cemetery. Thereafter registered under the Bombay Public Trust Act 1950 on 10th. October 1952, with the registration No. B-188 as a separate Trust. Santacruz Golibar Dargah Trust was registered with the Income Tax Department as on 2nd. July 1973, and the number allotted was TR/3112.

      Golibar Dargah Trust was amalgamated with Navpada Masjid Bandra Trust as per Bombay City Civil Court order dated 8th. July 1976 and th. October 1976 with common registration No. B-189 as “Navpada Masjid and Santacruz Golibar Dargah Trust.”

      As per the record the Dargah at Santacruz existed time immemorial i.e. over 300 years it was maintained and managed by the trustees of Navpada Masjid who were the members of the Kokni Jamat.

      As per the wakf committee findings report dated 8th. February 1949 Navpada Masjid Bandra wakf is in respect of the Masjid and Cemetery only, Dargah has no connection with the wakf.

      Haji Suleman Usman Mahimi, A managing trustee and five other Mutavallis were the rustees of Kokni Muslim Jamat managing the Navpada Masjid and Golibar Dargah Trust.

On 23rd. February 1905 Mr. Jacob Haji Essa made an application to the collector of Thane to erect a Mosque and guest house on a plot of ground at Santacrus on which a musalman saint Shaikh Sailani & Shaikh Jilani Dargah of an old date stood (Golibar Dargah)

There is an office note dated 20th. December 1907 bearing the initials of the special officer that Jacob was allowed to erect a mosque and a rest house on a plot out of 1 gunthas set apart for Dargah.

The mosque and rest house was completed in December 1908, after this a dispute has arisen between the manager of Dargah Haji Suleman Usman Mahimi and those of the Mosque M/s. Noor Mohd. Abdul Sattar and Mohd. Ismail Abdul Sattar. The Manager of Dargah say that the whole land of 18 gunthas with buildings thereon are in their possession and claimed the ownership of the plot.
Upto the year 1909 when the Kamjasti Patrak was made a Survey correction, there was no land in the village record in the name of Dargah.

There was a Dargah standing on Govt. land from times immortal and 18 guntas of land was merely set apart for that Dargah but no sanad had been issued.

The order of the Dargah of Bombay Suburban District made in 1936 shows that the Dargah bearing plot No. 304 S. No. 388 is managed by the trustees of Navpada Musjid Bandra.

Since the plot was not in the name of Govt. nor was it of their ownership, therefore Govt. had no right to grand the land of Dargah to the Mosque. But Aishabai and her two trustees are in complete possession of the Mosque property and it should be in their name in the record of rights.

The mosque trust was named as “Aishabai Wakf” (Aishabai wife of Haji Ibrahim Haji Tazmohammed and great grand mother of Noor Mohammed Abdul Sattar and Mohd. Ismail Abdul Sattar)

A letter dated 13.12.1978 from Hajani Aishbai Wakf states that they have given all powers of management including construction to the Anjuman Khaddamul Muslameen, Golibar, Santacruz (East). Prior to this the Anjuman requested the trustees of Navpada Masjid for permission to put up a RCC slab by a latter dated 31-12-1977 over the Masjid roof and main gate with a Gumbaj over the piece of land allotted to them from the Dargah plot by the trustees of Navpada Masjid.

The RCC slab, main gate job completed in 1982 for which a CC submitted on 14-10-1981. CC. No. CE/5654/BSII/AH of 25-Oct. 1982.

This job was completed by the committee registered with BPT on 27-1-1977 as Anjuman-e-Khaddamul Muslameen under the Societies Registration Act of 1860 (Act XXI of 1860) Maharashtra State registration No. BOM 34/1971.

On May 21st. 2002 “Anjuman-e-Khaddamul Muslameen Trust Address: Jama Masjid, Golibar Santacus (East) Bombay 400 055, regisered with BPT with a new body under PTR No. F2178 (B) (Draft scheme is with us).

On Dec. 30th. 2002 they applied for a NOC for the permission for renovation/construction of the Golibar Jama Majid, which was not granted on the ground that the additions of floors to the mosque by utilising more floor space index i.e. extra land from Dargah (we have already donated the earlier trust a piece of land for erecting the entrance gate in 1977.

Municipal No. HW 5334 (2) and HW 5334 (3) for burial ground. Registered with Bombay Municipal Corporation on 25th. June 1965.

No. H/Sub/85780 (BMC had sent letter for registration of cemetery on 26-8-1950, all the required details were submitted. Plot lies under Town Planning Scheme Bandra III (varied ) under Bombay Town Planning Act 1915.


      A survey of the plot was done on 2-10-1926 by our Architect and Surveyor Shri A. K. Sharif. Since there was very old barbed wire fencing around the whole land, it was decided to build a boundary wall, as the wall construction started Tatas started the dispute regarding the boundary wall on 8-5-1928.
